Welcome to the kavadea.com website (hereafter referred to as the Site”) which is operated by or for Kavadea or Kavadea Lifestyle Private Limited, its affiliates or related companies, referred to collectively as Kavadea or Kavadea Lifestyle Private Limited.

The following terms govern your use of and/or purchase of products from the Site. Be advised that your use of the Site constitutes your agreement to follow and be bound by all of the following terms and conditions (the “Agreement”). In Addition, the Site is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. By using our Service, you will be subject to and should also review any Shopify Inc. terms of use and related policies.

RETURNS

RETURNS AND REFUNDS

We do not offer returns on products purchased through the Kavadea website. All goods are final sale.

If goods purchased from the website are defective. Please reach out to hello.kavadea@gmail.com with the problem and then a return/refund/partial refund may be processed at the discretion of the Kavadea and Kavadea Lifestyle Private Limited customer service teams

GENERAL

We may from time to time change the terms that govern your use of the Site. Your use of the Site following any such change constitutes your agreement to follow and be bound by the terms as changed. We may change, move or delete portions of, or may add to, the Site from time to time, for any reason, with or without notice.

SITE CONTENTS

Unless otherwise noted, all materials, including images, illustrations, designs, icons, photographs, video clips, music, and written and other materials that appear as part of this Site (collectively, the “Contents”) are copyrights, trademarks, trade dress and/or other forms of intellectual property owned, controlled and/or used under license or with other legal authority by Kavadea or Kavadea Lifestyle Private Limited. The Site as a whole is protected by copyright and trade dress, all worldwide rights, titles and interests in and to which are owned by Kavadea or Kavadea Lifestyle Private Limited. The Contents of the Site, and the Site as a whole, are intended solely for personal, non-commercial (other than for the purchase of merchandise from the Site) use by the users of the Site. You may not reproduce, publish, transmit, distribute, display, modify, create derivative works from, sell or participate in any sale of, or exploit in any way, in whole or in part, any of the Contents, the Site, or any related software. 

THE USE OF ANY ROBOT, SPIDER, OR OTHER AUTOMATIC DEVICE OR SOFTWARE IN CONNECTION WITH THE SERVICES IS STRICTLY PROHIBITED. IN THE EVENT WE REASONABLY DETERMINE THAT ANY ORDER OR ATTEMPTED ORDER WAS MADE BY OR THROUGH USE OF ANY ROBOT OR OTHER AUTOMATIC DEVICE OR SOFTWARE, WE HAVE THE RIGHT, IN OUR SOLE AND ABSOLUTE DISCRETION, TO DENY OR CANCEL ANY SUCH ORDER, TO REFUSE TO ACCEPT ANY RETURNS OR OFFER REFUNDS, AND/OR TO CHARGE RESTOCKING FEES.

PAYMENT

You agree to pay all fees or charges to your Account in accordance with the fees, charges and billing terms in effect at the time a fee or charge is due and payable. You must provide a valid credit card (Visa, MasterCard, or any other issuer accepted by us) or PayPal account or APPLE PAY to Shopify, our third-party payment provider (“Payment Provider”) in order to purchase products and to use certain Services. Your credit card provider agreement governs your use of the designated credit card or PayPal or APPLE PAY account, and the terms and conditions on the website of the Payment Provider governs your use of its website, and you must refer to the respective agreement or terms and conditions, and not the Terms, to determine your rights and liabilities. By providing to Shopify, on behalf of Kavadea or Kavadea Lifestyle Private Limited, with your credit card number [or PayPal account] and associated payment information, you agree that Kavadea or Kavadea Lifestyle Private Limited is authorized to immediately invoice your Account for all fees and charges due and payable to Kavadea or Kavadea Lifestyle Private Limited hereunder and that no additional notice or consent is required. You agree to immediately notify Kavadea or Kavadea Lifestyle Private Limited of any change in your billing address or the credit card [or PayPal account] used for payment hereunder. Kavadea or Kavadea Lifestyle Private Limited reserves the right at any time to change its prices and billing methods, either immediately upon posting on Kavadea or Kavadea Lifestyle Private Limited Properties or by e-mail delivery to you.

ORDERS

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

CORRECTION OF ERRORS AND INACCURACIES

The information on the Site may contain typographical errors or inaccuracies and may not be complete or current. Kavadea or Kavadea Lifestyle Private Limited therefore reserves the right to correct any errors, inaccuracies or omissions and to change or update information at any time with or without prior notice (including after you have submitted your order). Please note that such errors, inaccuracies or omissions may relate to product description, pricing, product availability or otherwise. We apologize for any inconvenience this may cause. If you are not fully satisfied with your purchase you may return it in its original condition, with the original packing receipt within 10 days of the order date, subject to compliance with all other terms and conditions of the Kavadea or Kavadea Lifestyle Private Limited.

PRODUCT INFORMATION

Although availability may be indicated on the Site, we cannot guarantee product availability and products, nonetheless, may not be available for immediate delivery. We reserve the right, without liability or prior notice, to revise, discontinue, or cease to make available any or all products or to cancel any order. If there is any revision, discontinuance, or cessation, we may, in our discretion, ship products which have substantially similar functionality and specifications to the products ordered or cancel your order.

COLORS

We have made efforts to display accurately the colors of products that appear on the Site. However, as the actual colors you see will depend on your monitor and/or other technological circumstance, we cannot and do not guarantee that your monitor’s display of any color will be accurate.

THIRD PARTY PROVIDER

Shopify, Inc. provides Kavadea or Kavadea Lifestyle Private Limited payment services, and is Kavadea or Kavadea Lifestyle Private Limited’s third-party service provider (e.g., card acceptance, merchant settlement, and related services). By buying the Kavadea or Kavadea Lifestyle Private Limited Properties, you agree to be bound by Shopify’s Privacy Policy: https://www.shopify.com/legal/privacy and hereby consent and authorize the Kavadea or Kavadea Lifestyle Private Limited and Shopify to share any information and payment instructions you provide with Third Party Service Provider(s) to the minimum extent required to complete your transactions.

SHIPPING

Kavadea or Kavadea Lifestyle Private Limited will use commercially reasonable efforts to meet any shipment schedules set forth on the Site. However, any shipment date or forecast provided by Kavadea or Kavadea Lifestyle Private Limited is only an estimate of the time required to make shipment. Unless otherwise agreed to by Kavadea or Kavadea Lifestyle Private Limited, all items will be shipped by Kavadea or Kavadea Lifestyle Private Limited, or its designated representative, in the Kavadea or Kavadea Lifestyle Private Limited’s standard packaging using a delivery service specified by Kavadea or Kavadea Lifestyle Private Limited. To the extent that the Site contains links to outside services and resources, the availability and content of which Kavadea or Kavadea Lifestyle Private Limited does not control, any concerns regarding any such service or resource, or any link thereto, should be directed to the particular outside service or resource.

SHIPPING POLICY

PROCESSING TIME

SHIPPING METHODS DO NOT INCLUDE PROCESSING TIME. You will receive an email from hello@kavadea.com when your order has been confirmed.  Please allow 7-10 business days for your order to be processed. Shipping times may increase during holidays and other peak seasons. Purchased items will be shipped within 10 business days of the order, although most will be shipped within 3 to 4. Please allow up to 2 weeks for your delivery to arrive. If you still have not received your purchase after 3 weeks, please contact us at hello.kavadea@gmail.com

TAXES, SHIPPING & HANDLING CHARGES

All India orders are shipped via DELHIVERY or DTDC. All USA orders are shipped via UPS, USPS or Fedex or DHL. All international orders are shipped via UPS or Fedex or DHL. Carriers are selected based on the most efficient delivery.

All international orders may be subject to sales tax, import duties, and customs charges at the receiver’s expense. This rate is determined by the receiving country. please contact your local customs for further information.

FAILED DELIVERY/RETURNED TO SENDER

If the package cannot be delivered to the given shipping address due to causes ascribable to the absent cooperation of the customer (wrong or incorrect phone number, wrong or incorrect shipping address, absent receiver,) or if the customer refuses to collect the package, the package will be returned to the sender (KAVADEA LIFESTYLE PRIVATE LIMITED) at the customers expense. The expense includes shipping costs and any duty and tax the package may have incurred; this amount will be deducted from the total of the order to be refunded.

DAMAGED/OPENED BOX

If you receive your package, and it is damaged and/or opened, please take a photo of the damage before checking the contents inside. Please submit a claim via the courier used to ship your order.

RESTRICTIONS
Kavadea or Kavadea Lifestyle Private Limited:

– is unable to ship to PO boxes.

– is unable to combine separate orders into a single shipment.

– is unable to change any shipping addresses. We will only ship to the address entered at the time the order was originally placed.

– is unable to cancel or modify an order.

– is unable to price match or make price adjustments.

ABANDONED PACKAGE

Customers are responsible for any additional shipping fees associated with a returned package or exchange. KAVADEA LIFESTYLE PRIVATE LIMITED will either send an invoice to you for the costs, or you are able to provide us with a prepaid shipping label. Kavadea will only hold your package for 30 days before it is deemed abandoned. After 30 days, an abandoned package will forfeit the right to an exchange or refund.

RETURN POLICY

REFUND OR EXCHANGE WHEN PURCHASED AT RETAIL PRICE. ALL DISCOUNTED ITEMS ARE FINAL SALE.

All returns must be authorized by requesting a return at hello.kavadea@gmail.com.  Returns must be sent within 14 days of shipment receipt for any problems or concerns with merchandise. The goods should be returned in their original, undamaged packaging with both the printed receipt and return form for a refund or exchange.  All exchanges dependent on existing stock.

Under these circumstances we cannot refund any postage charges with the exception of faulty or incorrectly shipped items * or accept items that are not in their original packaging or not in a re-sellable, like new condition.  

Kavadea or Kavadea Lifestyle Private Limited will not issue credits or refunds for any difference in price on items purchased before the start of any sale. Orders placed at retail price, will have any refund or exchange option available, while those purchasing at a sale price are considered final sale. All processed orders shipped before the start of any sale, may not be exchanged for items at their discounted price. For any problems or concerns with the merchandise notice must be given to hello.kavadea@gmail.com, within 2 days of shipment receipt.

To exchange an item it must have the original packaging, in as-new condition with both tags and printed receipt when returned. Domestic customers are financially responsible for shipping the item back to Kavadea or Kavadea Lifestyle Private Limited for the exchange. International customers are financially responsible for shipping the item back to Kavadea or Kavadea Lifestyle Private Limited for the exchange, as well as for shipping the exchanged item back to their respective country. 

Any product shipped back to Kavadea or Kavadea Lifestyle Private Limited as an RTS (Return To Sender) for failure to deliver/receive/collect from the carrier or facility, will be subject to a Rs. 200 RTS Fee to cover reshipment costs. All customers should receive tracking details upon dispatch, and are expected to monitor tracking progress for any delivery exceptions. The customer will be notified of said return by a service representative, the delivery address will be re-confirmed, and the RTS Fee must be made payable through the original payment method.
